1. General Provisions
The AvtoShare.az platform (hereinafter "Platform") provides users with the opportunity to post vehicle rental listings and find suitable offers. By using the Platform, you confirm your full agreement with these terms. If you do not agree with these terms, you must not use the Platform. The Platform operates in accordance with the Civil Code of the Republic of Azerbaijan, the Law "On Protection of Consumer Rights", the Law "On Personal Data", and other relevant regulatory legal acts.
2. Platform Role & Status
AvtoShare.az operates solely as an intermediary platform. The Platform is not a direct party to rental agreements and does not create any legal relationship between the parties. The Platform does not act as the owner, lessor, or lessee of any vehicle. All legal relations between the listing owner and the renter are determined directly between them and are subject to the relevant provisions of the Civil Code of the Republic of Azerbaijan.
3. Limitation of Liability
AvtoShare.az bears no responsibility for: • The accuracy, completeness, or relevance of listings • The technical condition, suitability, or safety of vehicles • Disputes, conflicts, or damages arising between users • Payment disputes, late payments, or non-payment • Accidents, injuries, or material damages during the rental period • Theft or damage to vehicles • False or incomplete information provided by users to each other • Violation of rental terms or non-fulfillment of contractual obligations • Damages resulting from third-party actions All risk and responsibility lies entirely with the renter and the listing owner.
4. User Obligations
Users bear the following obligations: • Provide accurate, real, and up-to-date information during registration • Bear personal responsibility for all information they provide • Use the Platform only for lawful purposes • Comply with the legislation of the Republic of Azerbaijan and these Terms of Service • Respect the rights of other users • Not interfere with the normal operation of the Platform
5. Payments & Financial Relations
All payment obligations are determined and carried out directly between users (renter and listing owner). AvtoShare.az does not participate in any stage of the payment process. The Platform bears no responsibility for payment disputes, delays, refunds, or financial losses. Payment method, timing, and conditions are determined by mutual agreement between the parties. Users are advised to keep documents (receipts, bank transfers, etc.) that can prove the payment.
6. Age Requirement & Driver's License
A minimum age of 18 is required to use the Platform. A valid driver's license in accordance with the legislation of the Republic of Azerbaijan is required to rent a vehicle. Some vehicles (luxury, heavy transport) may require an age of 21 or above. Motorcycle rental requires a Category A driver's license. Verify exact age and license requirements with the vehicle owner. Operating a vehicle with an invalid driver's license constitutes liability under the Administrative Offenses Code of the Republic of Azerbaijan.
7. Account & Registration
Each user may create only one account. Registration with false, misleading, or another person's information is prohibited and may constitute liability under the Criminal Code of the Republic of Azerbaijan. Accounts cannot be transferred, sold, or shared with third parties. Account security (password, login credentials) is the user's own responsibility. The Platform reserves the right to immediately block an account without prior notice in case of reasonable suspicion.
8. Listing Rules
Listing owners must comply with the following rules: • Posting false, misleading, or unrealistic listings is prohibited • Listing stolen, pledged, wanted, or legally problematic vehicles is prohibited • Prices, features, and images shown in listings must be accurate • The listing owner must be the legal owner or authorized representative of the vehicle • Duplicate listings for the same vehicle are prohibited AvtoShare.az reserves the right to remove, edit, or deactivate any listing without stating a reason.
9. Deposit & Security
Deposit terms are determined between the vehicle owner and the renter. The Platform bears no responsibility for any deposit-related disputes. Deposit amount, return period, and conditions should be agreed upon in writing before the rental begins. Both parties are advised to keep written documentation (receipts, messages) regarding the deposit.
10. Damage, Insurance & Accidents
All responsibility for damage to the vehicle during the rental period lies entirely with the renter. Insurance matters are resolved separately between the parties. Documenting the vehicle's condition with dated photos/videos before rental is recommended for both parties. In case of an accident, the parties must act in accordance with the Traffic Rules and relevant legislation of the Republic of Azerbaijan. The Platform bears no responsibility for accidents or injury incidents.
11. Rental Period & Return
The vehicle must be returned within the agreed period and in the agreed condition. In case of late return, additional payment may be required. Conditions are determined by the vehicle owner. Documenting the vehicle's condition with photos/videos upon return is recommended. The renter is responsible for any damage discovered during the return.
12. Cancellation & Refunds
Cancellation terms are set by the vehicle owner. In case of late cancellation, the deposit may be fully or partially forfeited. Verify cancellation terms with the vehicle owner before booking. The Platform bears no responsibility for financial disputes arising from cancellation. Both parties are advised to keep written notification (messages, emails) about cancellation.
13. Prohibited Activities
The following activities are prohibited on the Platform: • Fraud, forgery, and illegal activities • Spam, advertising, and unauthorized commercial use • Insulting, threatening, pressuring, or harassing other users • Interfering with or damaging the Platform's technical infrastructure • Collecting or distributing personal data of other users • Using the Platform for money laundering or terrorism financing Accounts of users who violate these rules will be immediately terminated without prior notice. In case of legal violations, relevant law enforcement agencies will be notified.
14. Personal Data Protection
User data is collected, stored, and processed in accordance with the Law "On Personal Data" of the Republic of Azerbaijan. The Platform collects the following data: name, email, phone number, profile picture, listing information, and usage statistics. Personal data is not shared with third parties except in the following cases: • When the user gives explicit consent • When required by legislation • When there is a court order or request from law enforcement agencies Users can request deletion of their personal data by deleting their account.
15. Intellectual Property Rights
The Platform's design, logo, software, content, and all visual elements are the intellectual property of AvtoShare.az and are protected by the Law "On Copyright and Related Rights" of the Republic of Azerbaijan. Rights to images and content uploaded by users belong to the users. However, users grant the Platform the right to display, store, and use this content for service delivery purposes.
16. Force Majeure
In circumstances beyond the control of the parties (natural disasters, war, epidemics, government decisions, technical failures, etc.), the Platform bears no responsibility for delays or suspension of its obligations. Force majeure circumstances are applied in accordance with the relevant provisions of the Civil Code of the Republic of Azerbaijan.
17. Platform Suspension or Termination
AvtoShare.az reserves the right to temporarily suspend, modify, or completely terminate its service at any time. The Platform bears no responsibility or compensation obligation for damages caused to users as a result of service suspension or termination. The service may be temporarily unavailable for technical maintenance, updates, or security purposes.
18. Relations Between Parties
All legal relations arising between the renter and the listing owner belong directly to the parties. Relations between the parties are subject to the rental agreement provisions (Articles 700-724) of the Civil Code of the Republic of Azerbaijan. The Platform does not under any circumstances act as a representative, agent, or guarantor of either party. Disputes between parties are resolved between themselves or through the courts.
19. Account Deletion
Users have the right to delete their account at any time. When an account is deleted, personal data is anonymized, and listings, reviews, and other data are removed. Despite account deletion, active reservations and payment obligations remain in force. Account deletion does not release the user from existing obligations.
20. Changes & Dispute Resolution
AvtoShare.az reserves the right to unilaterally modify these terms at any time. Changes take effect once published on the Platform. Continued use of the Platform after changes constitutes acceptance of the new terms. Disputes arising from these terms shall be resolved first through negotiations, and where this is not possible, in the courts of the Republic of Azerbaijan. The legislation of the Republic of Azerbaijan applies to these terms.
